These Terms and Conditions (hereinafter referred to as “Terms”) govern your access to and use of the website www.maiswim.com (hereinafter referred to as “Website”) and any purchases made through it. By accessing or using this Website, you agree to these Terms. If you do not agree, you must refrain from using the Website.

These Terms comply with applicable laws and regulations of the United Arab Emirates (UAE), including but not limited to consumer protection, e-commerce, and data protection standards recognised in the UAE.

General Provisions

1.1. By accessing the Website, you confirm that you are at least 18 years old or have the permission of a parent or legal guardian to use our services.

1.2. These Terms constitute a legally binding agreement between the customer (hereinafter “you” or “customer”) and Maiswim (hereinafter “we,” “us,” or “our”).

1.3. We reserve the right to update or amend these Terms at any time. Changes will be effective upon posting on the Website. Continued use of the Website after any changes constitutes your acceptance of the updated Terms.

Pricing and Payment

2.1. All prices listed on the Website are in Euros (€) and include VAT or applicable sales taxes where required by law.

2.2. Prices are subject to change at any time without prior notice. However, the price displayed at the time of purchase is final and binding.

2.3. International Orders: For orders outside the UAE, additional taxes, duties, or customs fees may apply. These costs are borne by the customer and are not included in the purchase price. It is your responsibility to consult your local authorities for detailed information on these charges.

2.5. All payment information is processed through encrypted gateways compliant with international data protection and payment security standards. Maiswim does not store any credit or debit card information.

Orders

3.1. To place an order, you must provide accurate, complete, and up-to-date personal and payment information. We reserve the right to refuse or cancel any order if fraudulent activity is suspected or if the information provided is incomplete.

3.2. Once an order is placed, you will receive a confirmation email summarizing the purchase. This email does not constitute acceptance of your order but serves as an acknowledgment.

3.3. A binding contract is formed when the order is dispatched, and you will receive a final email confirming shipment.

Shipping and Delivery

4.1. Processing Time: Orders are typically processed within 1–2 business days.

4.2. Delivery Time: Shipping times vary based on destination:

* Within the UAE: 2–3 business days.

* International: Delivery times may vary and are subject to customs processing in the destination country.

4.3. Shipping Fees: Shipping costs are calculated at checkout and displayed prior to payment confirmation.

4.4. Customs and Duties: Customers outside the UAE are responsible for any additional charges imposed by their country’s customs authority. If you refuse to pay customs duties and the package is returned, we will deduct return shipping costs from your refund.

Returns and Refunds

5.1. Customers may return their purchases within 14 days of receiving the item, in accordance with applicable UAE consumer protection laws.

5.2. To initiate a return, customers must contact us at support@maiswim.pt, providing their order number and reason for the return (optional). Upon approval of the return, we will issue a prepaid return label via email. The customer must print and attach the label to the package before shipping it back to us.

5.3. Return Costs:

* The customer is responsible for the cost of the return shipping. The amount will be deducted from the refund once the return is processed.

5.4. Items must be returned in their original condition:

* Unused and unworn.

* With all tags and packaging intact.

* Accompanied by proof of purchase.

5.5. Refunds:

* Refunds will be processed within 14 days after we receive and inspect the returned items. Refunds will be issued to the original payment method, minus the return shipping cost.

5.6. Exchanges:

* Exchanges are subject to stock availability. Customers wishing to exchange an item must follow the same procedure as returns and indicate the desired replacement in their return request. The customer remains responsible for the cost of returning the item.

Intellectual Property

6.1. All content on the Website, including but not limited to text, images, designs, logos, and graphics, is the exclusive property of Maiswim or its licensors and is protected under UAE and international intellectual property laws.

6.2. Unauthorised reproduction, distribution, or use of any content from the Website is strictly prohibited and may result in legal action.

Limitation of Liability

7.1. Maiswim is not liable for any loss, damage, or delay caused by events beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, or disruptions in transportation or supply chains.

7.2. Our liability is limited to the value of the products purchased and does not extend to indirect, consequential, or incidental damages.

Security and Data Protection

8.1. Maiswim adheres to the highest standards of data security and complies with applicable UAE data protection regulations.

8.2. Personal information provided during transactions is encrypted using SSL technology and used solely for order processing, delivery, and customer support.

Governing Law and Jurisdiction

9.1. These Terms are governed by the laws and regulations of the United Arab Emirates.

9.2. Any disputes arising from these Terms, the use of the Website, or any transactions conducted through it shall be resolved exclusively by the competent courts of the UAE, unless otherwise stipulated by mandatory consumer protection laws in the customer’s country of residence.

Mobile Terms of Service

10.1. The Maiswim mobile message service (the "Service") is operated by Maiswim (“Maiswim”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

10.2. By consenting to Maiswim’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Maiswim through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

10.3. You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Maiswim. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

10.4. You may opt-out of the Service at any time. Text the single keyword command STOP to Maiswim or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Maiswim mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected
delivery of any information sent through the Service, any errors in such information, and/or any action you may or
may not take in reliance on the information or Service.

Final Provisions

11.1. If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.

11.2. These Terms constitute the entire agreement between the customer and Maiswim, superseding any prior agreements or understandings.
